With a criminal background, applying for an Electronic Travel Authorization (eTA)

For visa-exempt foreign nationals travelling to Canada via air, an electronic Travel Authorization (eTA) is required.

Canada has been using the eTA system to efficiently and securely handle and screen visitors since 2016. If arriving via air, nationals of visa-exempt countries will require an electronic travel authorization (eTA). If they're arriving by land or sea, they won't require one. Even if travelling to Canada by air, US citizens do not require an eTA.

For those without a criminal record, completing the eTA application is usually a simple process. Applicants must submit their requests via the internet. The cost of the application is only $7 CAD. Applicants usually receive their eTA within minutes.

However, if a person has had or is currently having contact with the criminal court system, they may be considered inadmissible to Canada. Even a conviction for driving under the influence (DUI) might result in criminal inadmissibility. You can take the help of Canada immigration consultants in India.

In general, there are three options for dealing with inadmissibility:

1.       Temporary Resident Permit

This document allows someone who is otherwise criminally inadmissible to enter Canada for a limited time. If the traveler is a United States citizen or permanent resident, they can apply for a TRP at a Canadian embassy or point of entry, such as an airport or border crossing. A TRP might be valid for as little as one day or as long as three years. It could be valid for only one entry into Canada, or it could be valid for several entries.

2.       Criminal Rehabilitation

Someone who was formerly inadmissible is granted permanent admittance through criminal rehabilitation. Whether or not you are eligible for criminal rehabilitation is determined by a number of circumstances. These are some of them:

a.       the crime(s) committed

b.       the penalty(s)

c.       the length of time since the sentence was completed (s)

If you were convicted of a crime or crimes in a foreign country and your sentence has been completed for more than five years, you may be eligible for criminal rehabilitation. Criminal rehabilitation is a one-time remedy that does not require renewal, unlike a TRP.

3.       Legal Opinion Letter

A legal opinion letter is another option for dealing with a probable criminal inadmissibility issue. This is a document that is prepared by a Canadian immigration lawyer. The letter discusses a previous accusation or conviction, as well as the legal conclusions reached by the lawyer. The lawyer will research Canadian legislation and explain why the person should be considered acceptable in Canada.
