Any one of the following three conditions must be met by your employment offer:
- Your employment offer comes from a company who has just completed a positive Labor Market Impact Assessment (LMIA), which indicates that the job offer has been approved and includes your name and position.
- You have a work permit issued on the basis of an LMIA and are currently working in Canada on a NOC 0, A, or B job.
- If you have a valid work permit, you are not required to complete an LMIA for a NOC 0, A, or B employment.
Valid job offer conditions under the Federal Skilled Trades (FST)
If you applied under the Federal Skilled Trades category, you must have a work offer from two companies, and the job offer must be in a skilled trade vocation in a position with 2016 NOC codes that begin with 72, 73, 82, 92, as well as 632 and 633.
Any one of the following three conditions must be met by your employment offer:
- Your job offer must come from an employer who has signed a positive LMIA approving the job offer and naming you and your workplace.
- You're working as a skilled tradesperson in Canada under a work permit that was granted after a positive LMIA.
- If you have a valid work visa for one of the specified skilled trade vocations, you are not required to complete an LMIA.
LMIA CONDITIONS
If an LMIA is attached to the job offer, it will be considered valid. This is something that the employer must apply for. When your employer receives a positive LMIA, they must provide you with a copy as well as a written job offer.
Some employment offers, however, are exempt from the LMIA; find out if yours is one of them.
